Winchester Truck Accident Lawyer

We are not the only drivers on the road. We share highways, bi-ways and side streets with trucks weighing many times the size of a four-door vehicle. If an accident occurs, the difference in size can result in serious, if not fatal, injuries. If you or a loved one has been injured due to a truck driver's negligence, our firm will represent your interests.

Rice & Heath, Attorneys at Law, is an established law firm that represents injured victims of truck accidents throughout central and eastern Kentucky. Our firm handles tractor-trailer, semi-truck, commercial vehicle and 18-wheeler accidents. We are dedicated to helping our clients secure the medical, economic and personal damages they deserve. You can count on our firm for assertive legal counsel.

What Caused the Accident?

Determining the cause of the accident is a critical part of a truck accident claim. Commercial trucks are heavily insured, so the most difficult part of the case is proving liability or fault. We will often visit the crash scene ourselves and work with accident re-constructionists, specialists and other experts to help determine the negligence that led to the serious injury or fatality.

Most trucking accidents fall into the following two main categories:

  • Truck driver error: including truck driver fatigue, driver failing to gauge stopping distance, illegal turning, pulling out into traffic, failing to see other motorists (bicyclists and pedestrians), lane changes into the path of another car, crossing the center line, driving too fast for weather conditions, driving under the influence of drugs or alcohol
  • Trucking company negligence: pushing drivers to exceed DOT limits on hours at the wheel, falsifying logbooks, exceeding weight limits, improperly loading or securing of freight, bald tires, bad brakes, and improper lights at night, improper loading checks and improper maintenance on vehicles

Many of the truck accidents we work on in Kentucky involve interstate haulers, as well as coal trucks operating in eastern Kentucky. We are very familiar with the state's freeways and rural highways known for crashes, including stretches of I-75, I-64, and feeder routes such as the Bluegrass Parkway, Mountain Parkway and U.S. 23.
